Terms of use

These terms apply when you use lekkersun.tech, with or without an account, and when you buy the Pro plan. Please read them before you subscribe. If anything is unclear, write to us.

Who we are

Lekker Sun is a sole proprietorship based in South Africa. You can reach us by email at hello@lekkersun.tech or through the contact form. The full supplier details that South African law requires are under Supplier information at the end of these terms.

How we handle personal information is set out in the privacy policy.

What Lekker Sun does, and what it does not

Lekker Sun helps you lay out solar PV and battery systems, estimate shading, production and savings, and make reports. Its figures are estimates. They depend on the information you enter, on climate data from third parties and on simplified models of real equipment and weather. Actual production and savings will differ.

Lekker Sun is a design aid, not a substitute for a qualified person. Whoever installs or signs off a system is responsible for checking the design, equipment ratings, string voltages, cable sizes and protection against the manufacturers' data, the wiring code (SANS 10142-1 in South Africa) and local rules, and for any certificate of compliance.

Accounts

You must be 18 or older to create an account. Keep your password to yourself and use a working email address, because that is how we reach you about your plan. You are responsible for what is done with your account.

The Pro plan

• Price. Pro costs R199 a month or R1,990 a year, in South African rand, as shown on the pricing page when you subscribe.
• Payment. You pay by card through Paystack, our payment provider. Paystack stores your card details; we never see your full card number.
• Automatic renewal. Pro renews automatically at the end of each month or year, and your card is charged the then-current price, until you cancel.
• Price changes. If the price changes, we will email you at least 30 days before it applies to your next renewal. You can cancel before then.
• Failed payments. If a renewal cannot be charged, Paystack tries again. Pro stays on for 3 days after the renewal date; after that your account moves to the free plan until a payment goes through.

Cancelling

You can cancel at any time: in the designer, open Account, then Manage subscription. You can also ask us by email. After you cancel, you are not charged again and Pro stays on until the end of the period you have already paid for. Deleting your account cancels the subscription straight away.

When Pro ends, your account and saved projects stay. You can still sign in to open, download and delete them. Saving new projects to your account needs Pro.

Refunds

• First payment. If you change your mind, write to us within 7 days of your first Pro payment and we will refund it in full, no questions asked.
• Mistakes. If you were charged twice or charged after cancelling, we refund the extra charge.
• Otherwise, renewals and part-used periods are not refunded. Cancelling stops the next charge.

Refunds go back to the card you paid with, normally within 5 to 10 working days, depending on your bank. Nothing in these terms takes away rights you have under the Consumer Protection Act or the Electronic Communications and Transactions Act.

The free plan and ads

The designer is free to use without an account. The free plan is paid for by ads, as described in the privacy policy. We may change what is included in the free plan.

Fair use

Please do not:

• try to get into accounts or parts of the service that are not yours
• overload the service, or scrape or call it automatically outside the designer
• copy, decompile or reuse the designer's code or calculation method
• resell or share a Pro account, or use the service for anything unlawful

We may suspend or close an account that breaks these rules. If we close a paid account for a reason other than a breach, we refund the unused part of the period.

Your projects and our software

Your projects, client information and logo remain yours. You let us store and process them only to run the service for you. Make sure you are allowed to store your clients' information here.

The Lekker Sun name, website, designer and calculation method belong to Lekker Sun. You may use reports you make for your own work and your clients.

Availability and changes

We work to keep Lekker Sun running and your data safe, but we cannot promise it will always be available or free of errors. Keep copies of important projects by exporting them. We may improve or change features. If a change takes away something important in Pro, we will tell you by email first, and you can cancel.

Liability

As far as the law allows, Lekker Sun is not liable for indirect or consequential loss, such as lost profits or the cost of fixing an installation, arising from the use of its estimates or reports. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. This does not limit liability that cannot be limited by law, including under the Consumer Protection Act.

Law and disputes

These terms are governed by the law of South Africa. If you have a complaint, write to us first and we will try to sort it out. You keep any right to approach a consumer body or court.

Changes to these terms

If we change these terms we will update the date at the top. If a change affects Pro subscribers, we will email them at least 30 days before it applies.

Supplier information

As required by section 43 of the Electronic Communications and Transactions Act 25 of 2002:

• Service and price: online solar design software. Pro costs R199 a month or R1,990 a year, in South African rand, with no delivery or other charges. Pro is switched on as soon as payment is confirmed.
• Payment: by card through Paystack. Card details are entered on Paystack's secure page, which is certified to the PCI DSS card security standard; our site uses an encrypted (https) connection throughout.
• Duration: one month or one year at a time, renewing automatically until cancelled, as described under The Pro plan and Cancelling
• Records of your transaction: Paystack emails a receipt for each payment. You can download your account and payment records at any time in the designer, under Account, then Download my data.
• Refunds and cooling-off: see Refunds. You may cancel within 7 days of your first payment for a full refund, in line with section 44 of the Act.
• Dispute resolution: we do not subscribe to an alternative dispute resolution code. Complaints go to us first, as described under Law and disputes.
